1. Introduction and Acceptance
Welcome to JobBlueLink, Inc. ("JobBlueLink," "we," "us," or "our"). These Terms of Service ("Terms") constitute a legally binding agreement between you (referenced herein as "you," "your," "User," or "Customer") and JobBlueLink governing your access to and use of our website, mobile applications (the "App"), and related services (collectively, the "Services").
By creating an account, accessing, or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use the Services.
If you are accessing the Services on behalf of a company or other legal entity (a "Customer" or "Employer"), you represent and warrant that you have the authority to bind that entity to these Terms. In that case, "you" and "your" will refer to that entity.
2. Definitions
- "User" or "Job Seeker"
An individual searching for employment, uploading a resume, or using the Services to apply for jobs.
- "Customer" or "Employer"
An individual or entity accessing the Services to post job advertisements, search for candidates, or manage hiring processes.
- "AI Features"
Any feature on the platform powered by artificial intelligence, machine learning, or generative algorithms, including but not limited to AI Profile Boosting, AI Portrait Reshaping, JD Creator, and AI Matching.
- "User Content"
All information, data, text, software, music, sound, photographs, graphics, video, messages, or other materials submitted, posted, or displayed by you on or through the Services.
3. Eligibility and Account Security
3.1 Age Restriction
You must be at least 18 years of age to use the Services. By using the Services, you represent and warrant that you meet this age requirement. Due to the collection of biometric data and precise geolocation, the Services are strictly prohibited for use by individuals under 18.
3.2 Identity Verification
To maintain the integrity of our marketplace and ensure the safety of our Users, JobBlueLink reserves the right, but constitutes no obligation, to verify your identity. You authorize JobBlueLink, directly or through third-party service providers, to make any inquiries we consider necessary to validate your identity. This may include asking you for further information, requiring you to take steps to confirm ownership of your email address or financial instruments, or verifying your information against third-party databases or through other sources. Failure to provide such information upon request constitutes a breach of these Terms and may result in the immediate suspension or termination of your Account.
3.3 Account Security
To access certain features, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your password and for all activities that occur under your account. You agree to notify JobBlueLink immediately of any unauthorized use of your account. JobBlueLink will not be liable for any loss or damage arising from your failure to comply with these requirements.
4. Services for Job Seekers (AI & Features)
4.1 Resumes, Profiles and Visibility
By creating a public profile or uploading a resume, you authorize and license JobBlueLink to make your User Content available to third parties, including Employers and our matching algorithms. You acknowledge that we may parse your resume into different formats to facilitate job matching. You acknowledge that once your resume has been accessed or downloaded by a third party, JobBlueLink has no control over the retention, use, or dissemination of that copy. You are solely responsible for the accuracy and content of your resume.
4.2 AI-Powered Profile Boosting (Generative AI) and Matching
JobBlueLink offers "Profile Boosting" tools powered by Large Language Models (LLM) to assist you in rewriting resumes and profiles.
- • No Guarantee: You acknowledge that AI technologies are probabilistic and may generate incorrect, misleading, or "hallucinated" content. You are solely responsible for reviewing, verifying, and editing all AI-generated content for accuracy and truthfulness before using it. JobBlueLink makes no warranties regarding the suitability of AI-generated text for any specific job application.
- • Accuracy: While AI Profile Boosting aims to improve your visibility, you are solely responsible for reviewing and verifying any AI-generated text or modifications to your profile to ensure accuracy and truthfulness before publishing.
- • Ownership: As between you and JobBlueLink, you own the specific output generated for you by the AI Features, provided you have complied with these Terms. You grant JobBlueLink a worldwide, non-exclusive, royalty-free license to use this content for any purpose including but not limited to improve our models.
4.3 AI Portrait Reshaping and Video Introductions (Biometric Data)
This Section 4.3 applies to your use of the "AI Portrait Reshaping" and any other features that process facial imagery. By using these features, you acknowledge that they may involve the collection, analysis, and storage of data that may be considered "Biometric Identifiers" or "Biometric Information" (collectively, "Biometric Data") under laws such as the Illinois Biometric Information Privacy Act (BIPA) or the Texas Capture or Use of Biometric Identifier Act (CUBI).
Our Services include features that allow you to use AI to reshape portraits or generate self-introduction videos.
- • Consent to Collect: By uploading a photograph for AI processing, you explicitly consent to JobBlueLink and its third-party service providers collecting, capturing, and processing your facial geometry for the sole purpose of generating your stylized portrait or verifying your identity.
- • Retention: We will retain your Biometric Data only as long as necessary to perform the requested service or, at most, within 30 days of account deletion, whichever is shorter, after which time it will be permanently destroyed.
- • Deepfake Prohibition: You are strictly prohibited from using the Services to create images or videos of any person other than yourself without their express written consent. You may not use the Services to generate deceptive media ("deepfakes") intended to mislead regarding identity, or to generate sexually explicit content. Violation of this clause will result in immediate, permanent suspension and report to law enforcement.
- • License: You grant us a worldwide, non-exclusive, royalty-free license to host, display, and reproduce your video and image content, and any derivative works, for the purpose of operating the Services.
- • Release: You hereby release and hold harmless JobBlueLink and its service providers from any liability under BIPA, CUBI, or similar statutes, arising from the processing of your images in accordance with these Terms, provided that JobBlueLink complies with the retention and destruction policies outlined herein.
4.4 GPS Job Matching and Attendance Verification
The App uses your device's location services to show you job opportunities in your immediate vicinity.
- a. Authorization: By enabling location services, you authorize JobBlueLink to collect your precise location data.
- b. Control: You may disable location services at any time in your device settings, though this will disable the "Near Me" job search functionality.
Job Discovery: JobBlueLink utilizes your mobile device's Global Positioning System (GPS) to identify employment opportunities near your current location. By enabling location services, you consent to our collection and processing of your location data to provide these features.
Attendance Verification and Hiring Confirmation: JobBlueLink provides location-based services to allow Employers to verify the attendance and location of workers during scheduled shifts ("Location Verification"). This feature utilizes the background location capabilities of the User's mobile device. You acknowledge and agree that if you accept a job offer or utilize the "First Day Check-In" feature, JobBlueLink may collect your precise location data to verify your attendance at the Employer's designated work site. You expressly consent to the sharing of this specific location verification timestamp and status with the relevant Employer. By enabling Location Verification in the App, you grant JobBlueLink permission to collect and process your precise geolocation data.
- a. Limited License: You grant a license to use this data solely for the purpose of verifying your attendance and generating timesheets for your Employer.
- b. Background Tracking: You acknowledge that to function properly, the App may collect location data even when the App is closed or not in use, but only while you are in a "Clocked In" or "On Shift" status.
- c. Revocation: You may revoke location permissions at any time through your device settings; however, doing so may prevent you from using the Attendance features and may impact your employment standing with your Employer.
4.5 Salary Estimations
JobBlueLink may provide estimated salary ranges for Job Listings based on historical data and third-party sources ("Estimated Salaries").
- • For Informational Purposes Only: Estimated Salaries are approximations and are not provided by the Employer unless explicitly stated. They do not represent a guarantee of compensation.
- • No Legal Reliance: JobBlueLink disclaims any liability for discrepancies between Estimated Salaries and the actual compensation offered. You should verify salary details directly with the Employer.
5. Services for Employers
5.1 Job Postings and Compliance
You are solely responsible for the content of your job postings ("Job Ads"). You represent and warrant that your Job Ads comply with all applicable laws, including but not limited to the Fair Labor Standards Act (FLSA), Title VII of the Civil Rights Act of 1964, the Americans with Disabilities Act (ADA), and all applicable state and local laws regarding anti-discrimination, wage transparency, and fair hiring practices. JobBlueLink reserves the right to remove any Job Ad that we deem, in our sole discretion, to be in violation of these Terms or the law.
5.2 AI Job Description (JD) Creation
JobBlueLink offers an AI-driven feature to assist in drafting Job Descriptions.
- • Human Review Required: This content is generated by artificial intelligence. You acknowledge that AI can make errors ("hallucinations"). You agree to review, edit, and verify all AI-generated Job Ads for accuracy and legal compliance before posting. JobBlueLink is not responsible for any liability arising from AI-generated content or text. You acknowledge that you are the "deployer" of the AI tool and assume all liability for the final content of the job posting.
- • Ownership: As between you and JobBlueLink, you own the final content of the Job Ad you post, and grant a worldwide, non-exclusive, royalty-free license to JobBlueLink to display it.
5.3 AI Applicant Matching and Automated Decisions
JobBlueLink provides AI-driven matching to rank applicants.
- • Human-in-the-Loop: You agree that JobBlueLink's AI tools are decision-support tools only. You remain the sole decision-maker in the hiring process. You agree to independently review candidates and ensure that no hiring decision is made solely based on an automated score or ranking.
- • Bias Audits (NYC Local Law 144/Colorado AI Act): If you are in a jurisdiction requiring bias audits for Automated Employment Decision Tools (AEDT), you are responsible for ensuring your use of our tools complies with local notice and audit requirements. JobBlueLink provides audit data upon request but does not guarantee compliance for your specific use case.
- • Bias Mitigation: While we strive for fairness, you are responsible for ensuring your hiring practices comply with the Equal Employment Opportunity Commission (EEOC) guidelines and other applicable regulations.
- • Indemnification: You agree to indemnify and hold harmless JobBlueLink against any claims, damages, or fines arising from your use of AI Matching tools in a discriminatory manner or in violation of AEDT regulations.
5.4 GPS Attendance Verification
You may use our location verification feature solely to confirm a new hire's attendance on their first day or for interview attendance verification. You agree not to use this feature for continuous surveillance, stalking, or any unlawful purpose. You represent that you have obtained any necessary consents from the employee required by local labor laws.
If you use JobBlueLink’s GPS tracking features to verify employee attendance ("Hiring Confirmation" or "First Day" tracking):
- • Employer Obligations: You represent and warrant that you have (i) provided written notice to your employees that their location is being tracked during work hours, and (ii) obtained any and all necessary written consents as required by state law (e.g., California Penal Code § 637.7).
- • Limitation: You agree to use location tracking strictly for business purposes during scheduled working hours. You shall not track Users while they are off-duty.
- • Indemnification: You agree to indemnify and hold harmless JobBlueLink against any claims arising from your failure to obtain proper consents for location tracking.
5.5 One-Time Payments and Boosts Services
In addition to subscription services, JobBlueLink may offer one-time paid features (e.g., "Urgent Hiring" posts or "Post (Job Listing) Boosts").
- • Payment Terms: Fees for one-time services are due immediately upon order.
- • No Refunds: One-time payments are non-refundable once the service has been delivered (e.g., once the Boost has been applied to the post), regardless of whether the post results in a hire.
6. Community and Communication
6.1 Professional Identity and Authenticity
As a member of the JobBlueLink community, you are joining a network of tradespeople, contractors, and industrial professionals. To ensure a safe, productive, and professional environment for everyone, you agree to the following terms regarding your use of our social networking features.
- • Real Identity: JobBlueLink is a professional network. You agree to use your real name and provide accurate information about your identity, current employer, trade union affiliations, and location. Creating fake profiles or impersonating another person, contractor, or business is strictly prohibited.
Accurate Representation of Skills: You agree that all claims regarding your certifications, licenses, safety training (e.g., OSHA certifications), and trade skills are truthful and accurate.
6.2 Community Guidelines
JobBlueLink provides community features (chat, forums, feed posts, comments) for Users to discuss job-related topics. You agree not to use these features to:
- • Harass, abuse, defame, or threaten others.
- • Post illegal, obscene, or hateful speech content.
- • Solicit Users to leave JobBlueLink to circumvent our fees.
- • JobBlueLink reserves the right to moderate content but assumes no obligation to do so. JobBlueLink is an interactive computer service provider. We are not responsible for User Content posted in community forums and disclaim any and all liability under Section 230 of the Communications Decency Act.
6.3 Content Moderation
JobBlueLink has the right, but not the obligation, to monitor, screen, edit, or remove any User Content at our sole discretion. We reserve the right to suspend or ban Users who violate these Community Guidelines.
6.4 Job Site Confidentiality and Safety
Given the nature of industrial and construction environments, you agree to observe the following specific rules regarding uploaded media and posts:
- • Confidentiality: You will not post photos, blueprints, or descriptions of job sites that violate non-disclosure agreements (NDAs) or the confidentiality policies of your employer or the site owner.
- • Safety Violations: You will not post content that promotes, glorifies, or encourages unsafe working conditions, the bypassing of safety protocols, or the misuse of heavy machinery and tools.
6.5 Groups and Trade Communities
- • Participation: When joining and participating in trade-specific Groups, you agree to abide by any additional rules set by the Group Administrators.
- • Group Administration: If you create or manage a Group, you are responsible for moderating its content and ensuring that your group members comply with these Terms of Service. JobBlueLink reserves the right to remove Group Administrators or shut down Groups that violate our community standards.
6.6 Endorsements and Recommendations
- • You agree to only provide skill endorsements and written recommendations for individuals with whom you have actual, verifiable working experience. Buying, selling, or trading fake endorsements to artificially inflate a profile's reputation is prohibited and may result in account suspension.
6.7 Enforcement and Content Removal
- • JobBlueLink reserves the right (but assumes no obligation) to review, monitor, and remove any posts, comments, photos, or messages that we determine, in our sole discretion, violate these Terms of Service.
- • We may suspend or terminate the accounts of users who repeatedly violate these community guidelines.
6.8 SMS and Text Messaging (TCPA)
By providing your mobile number, you provide express written consent to receive automated job alerts and account notifications from JobBlueLink.
- a. Opt-Out: You can cancel SMS services at any time by texting "STOP" to the shortcode provided. Message and data rates may apply.
- b. Frequency: Message frequency varies based on your activity and preferences. Standard message and data rates may apply.
7. Mobile Application Terms
7.1 License
Subject to these Terms, JobBlueLink grants you a limited, non-exclusive, non-transferable, revocable license to download and use the Application ("App") on a compatible mobile device.
7.2 Location Data Transparency (Google/Apple Compliance)
The App may request access to your device's location services, including "Background Location."
- • Disclosure: We collect background location data only to enable the "Attendance Verification" feature, which allows your Employer to verify your presence at a job site even when the App is closed.
- • Control: You can enable or disable this access in your device settings. If you deny permission, the Attendance Verification feature may not function, which may prevent you from logging shifts.
7.3 Apple-Specific Terms
If you download the App from the Apple App Store, you acknowledge that:
- • These Terms are between you and JobBlueLink, not Apple;
- • Apple has no obligation to furnish any maintenance or support services for the App;
- • Apple is a third-party beneficiary of these Terms and has the right to enforce them against you.
8. Payments and Subscriptions
8.1 Subscriptions
Certain Services are offered on a subscription basis ("Subscription"). You agree to pay the fees associated with your chosen plan.
8.2 Automatic Renewal
YOUR SUBSCRIPTION WILL AUTOMATICALLY RENEW AT THE END OF EACH BILLING CYCLE UNLESS YOU CANCEL IT. BY SUBSCRIBING, YOU AUTHORIZE JOBBLUELINK TO CHARGE YOUR PAYMENT METHOD FOR THE RENEWAL TERM AT THE THEN-CURRENT RATE.
8.3 Cancellation
You may cancel your Subscription at any time through your Account Settings or by contacting support.
- • Cancellation Effect: Cancellation will be effective at the end of your current billing period. You will continue to have access to the Services until that date.
- • No Refunds: Except as required by law, paid Subscription fees are non-refundable.
8.4 California Cancellation Rights
If you are a resident of California, you may cancel your Subscription at any time and may be entitled to a pro-rated refund if you cancel within the first three (3) days of the initial purchase. You may cancel online without needing to speak to a representative.
9. Intellectual Property Rights
9.1 Ownership and License to User Content
a. Content Ownership
You retain ownership of all the User Content you post on JobBlueLink, including your resume, profile data, job site photos, comments, and messages. Nothing in these Terms deprives you of the rights you have to your own content.
b. License Grant
By posting, uploading, or sharing User Content on the Services (including public areas, trade groups, or your professional profile), you grant JobBlueLink a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, display, distribute, modify, and translate your User Content. This license is granted strictly for the purpose of operating, providing, and improving the Services—such as displaying your resume to prospective employers or showing your trade updates and photos in your connections' feeds.
c. Termination of License
This license terminates when you delete your User Content or close your JobBlueLink account. However, you acknowledge and agree that:
- • Shared Content: If you shared your User Content with others through the Services (e.g., posting in a public trade group or sending a direct message) and they have copied, re-shared, or stored that content, your deletion will not remove those copies.
- • Backups: It may take a reasonable amount of time to fully remove your deleted content from our backup systems and server logs.
9.2 JobBlueLink IP
Except for User Content, all rights, title, and interest in the Services, including our software, AI algorithms, look and feel, and trademarks, are the exclusive property of JobBlueLink or its licensors and are protected by copyright, trademark, trade secret and other intellectual property laws.
9.3 Feedback
If you provide suggestions or feedback regarding the Services, you agree that JobBlueLink may use such feedback without any obligation or compensation to you.
9.4 Copyright Infringement and DMCA Policy
JobBlueLink respects the intellectual property rights of others and expects our Users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), we will respond expeditiously to claims of copyright infringement committed using the Services that are reported to our Designated Copyright Agent.
a. Filing a Takedown Notice
If you are a copyright owner, or are authorized to act on behalf of one, and you believe in good faith that any material provided on the Services infringes upon your copyrights, you may submit a DMCA Takedown Notice to our Designated Copyright Agent containing the following information:
- • A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed;
- • Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works;
- • Identification of the material that is claimed to be infringing and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material (e.g., the specific URL of the post or image);
- • Information reasonably sufficient to permit us to contact you, such as an address, telephone number, and, if available, an email address;
- • A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and
- • A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

c. Counter-Notice
If you believe that your User Content that was removed (or to which access was disabled) is not infringing, or that you have the authorization to post and use such content, you may send a counter-notice containing the following information to the Copyright Agent:
- • Your physical or electronic signature;
- • Identification of the content that has been removed and the location (URL) at which the content appeared before it was removed;
- • A statement under penalty of perjury that you have a good faith belief that the content was removed as a result of mistake or a misidentification of the content; and
- • Your name, address, telephone number, and email address, and a statement that you consent to the jurisdiction of the federal court, and that you will accept service of process from the person who provided notification of the alleged infringement.
d. Repeat Infringer Policy
In accordance with the DMCA and other applicable law, JobBlueLink has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, Users who are deemed to be repeat infringers. We may also, at our sole discretion, limit access to the Services and/or terminate the accounts of any Users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
10. Disclaimers
THE SERVICES, INCLUDING ALL AI FEATURES AND LOCATION TRACKING, ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. JOBBLUELINK DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF ACCURACY, MERCHANTABILITY, AND FITNESS FOR A PARTICULAR PURPOSE.
- • Employment: We do not guarantee that Job Seekers will find a job or that Employers will find a qualified candidate.
- • AI Features: We do not guarantee that AI-generated content (resumes, JDs, portraits) is accurate, unique, or error-free. You use AI features at your own risk.
- • Location Data: We do not guarantee the accuracy or availability of GPS data or location services.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL JOBBLUELINK BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
- (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES;
- (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES;
- (C) ANY CONTENT OBTAINED FROM THE SERVICES; OR
- (D) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.
IN NO EVENT SHALL JOBBLUELINK'S AGGREGATE LIABILITY EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS (U.S. $100.00) OR THE AMOUNT YOU PAID JOBBLUELINK, IF ANY, IN THE PAST SIX MONTHS FOR THE SERVICES GIVING RISE TO THE CLAIM.
TO THE FULLEST EXTENT PERMITTED BY LAW, JOBBLUELINK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE. IN NO EVENT SHALL JOBBLUELINK'S AGGREGATE LIABILITY EXCEED THE GREATER OF ONE HUNDRED US DOLLARS ($100) OR THE AMOUNT YOU PAID JOBBLUELINK IN THE PAST SIX MONTHS.
12. Indemnification
You agree to defend, indemnify, and hold harmless JobBlueLink from and against any claims, damages, obligations, losses, liabilities, costs, and expenses arising from: (a) your use of the Services; (b) your violation of these Terms; (c) your violation of any third-party right, including copyright, property, or privacy rights (specifically including claims related to BIPA or GPS tracking consents).
13. Dispute Resolution and Arbitration
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
13.1 Binding Arbitration
Any dispute arising from these Terms or your use of the Services shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Consumer Arbitration Rules.
13.2 Class Action Waiver
YOU AND JOBBLUELINK AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Further, unless both you and JobBlueLink agree otherwise, the arbitrator may not consolidate more than one person's claims.
13.3 Arbitration Rules
The arbitration will be administered by the American Arbitration Association ("AAA") in accordance with the Consumer Arbitration Rules (for Users) or Commercial Arbitration Rules (for Customers). The arbitration will be conducted in the county where you reside or at another mutually agreed location.
13.4 Opt-Out
You have the right to opt-out of this Arbitration Agreement by sending written notice to JobBlueLink Legal Department within 30 days of creating your account.
14. Prohibited Activities
You agree not to:
- •Use any automated means (robots, spiders, scrapers) to access the Services or collect data without our express written permission.
- •Reverse engineer, decompile, or attempt to derive the source code of the Services or our AI models.
